That makes two youth of nearly the same age from my home away from home on Gabriola killed by idiots. But our justice system will make them pay with a couple weeks of community service. Yay justice.

Not guilty verdict in Nanaimo nightclub death

Three men accused of manslaughter following a bar fight two years ago walked free on Friday.

B.C. Supreme Court Justice Douglas Halfyard delivered his reasons for judgment to a courtroom packed with friends and family of both the accused and the victim.

Michael Brophy, 20, died from internal bleeding in the brain caused by blunt trauma to the head after a fight broke out in the now-defunct Grizzly Bar on Oct. 21, 2006.

Timothy Maybin, 23, Matthew Maybin, 25, and Buddha Gains, 41, a bouncer at the bar, stood trial by judge alone for manslaughter.

Halfyard said he is satisfied beyond a reasonable doubt that Timothy Maybin, Matthew Maybin and Gains participated in an assault against Brophy, and that Timothy Maybin and Gains both caused bodily harm to the deceased.

But he said either man could have struck the blow that caused the fatal injury leading to Brophy’s death, or it could have been a combination of both.

Halfyard said it was also not proven the three men acted in a co-ordinated assault against Brophy.

“None of the three accused can be found guilty of manslaughter,” he said.

Halfyard recommended the Crown pursue new charges against all three of assault causing bodily harm. Crown counsel Brian Jones said the Crown is reviewing its options.

I really hope they pursue further charges against this trio of thugs. The brothers and bouncer deserve to serve time for this incident. I understand that they couldn't pin point which person or which blow killed the man, but all were a part of his death.

Charge them with assault causing bodily harm and throw the book at them - full sentencing, no parole.

Bar fights happen and unfortunately this one caused another persons death, the bouncer is paid to keep this kind of stuff under control and instead of punching the guy in the back of the head while he is unconscious and obviously not a threat or a nuisance.. throws him out the door.. the bouncer is paid to do his job and in this case he didn't do his job but only made it worse... yes the two who were in the fight should be reprimanded with assault but when you are paid to do a job to stop violence and bar fights then I believe he should be held accountable for this. I believe the right thing the bouncer should have done was stop the fight and call 911 for medical assistance.. he did neither but added to the violence which caused a death.
