    Thanks Kickidee, As I was out busking today I spoke with Veneta Roberge ( Deputy license inspector) and was informed that the injunction is still in place from 2003. It's real strange since the injuction is against me I should have a copy of it I have been to the courthouse and pulled my file and there is no injuction in that file. Apparently I will have confirmation this week about the injuction which I will post if it really exists. Because this is a chat forum and this thread is about busking lets continue to keep it going chatting about busking I don't think I should appologize for the amount of pages this thread has or how many posts are on here. I didn't write them all

    If you can, contact an attorney and see if there is a way to challenge the injunction. I mean, it's been like 5 years now. Kinda silly to have them still have this against you after all that time. I don't know what the rules are. But I believe it starts with a simple motion form. Again, an attorney would know.

    I think TH if we had people who are honest and up front about things at the bylaw office then we would all know the truth about the injuction.
    It's not a big deal as I don't violate the busking bylaw anyway but it would be nice if there was an injuction if they would tell the truth about it.
    Or perhaps if they would give me a copy of it then I would have something to work with. I have tried many times to get answers from bylaw staff with no success. I don't believe it makes me look bad they are the ones that look like they are not doing their job.

    I'm just getting off the injunction for a this post as now we are being contacted by people who have some answers including the Seattle times.
    There will allways be buskers in Nanaimo with a good bylaw or a bad bylaw they will allways be out there. When many people talk about the arts they think about painters, carvers, theatre groups and more But one thing a lot of people are not aware of is that buskers fall into the category of the arts, Performing arts. It should be intresting as the bylaw office tries to put in a new street entertainers bylaw and measure sound by metres instead of decibles like it should be. Maybe they should ask a sound expert how to measure sound.

    It would be interesting to see some of the answers and responses. Its about time you had a response from somewhere. It is strange that no one asked the buskers to help create the bylaw so they had a clue about sound measurements etc. That was the first mistake in the friction that the inconsistancies caused, even before the blatant favoratism and the harrassment.

    According to Linda Murray, (Risk Manager) @ the city of Nanaimo A court order is a court injunction so this means that there is a court injunction in place which is permanent until such time as I challenge it in court this will be something that I will persue very quickly and will also ask the court to set a trial date for me to defend myself against allegations of violating the street entertainers bylaw. I found Linda Murray a very pleasant person to talk to and full of information A good choice for to be in the position of Risk Manager.
    It's unfortunate that bylaw services don't have the same skills.

    Yes TH she told me that was the only option I had and I could also ask the trial coordinator to bring my case to trial so I can go before the judge and defend myself against the allegations of violating the street entertainers bylaw. My statement of defence has been sitting in the courthouse since the court order was granted. I will go ahead with those options and ask that the court order against me be removed.
