Trollers must want that celtic type sound to give it that by the sea atmosphere. Danny is not the only celtic style in the box, and when he is busking, is trollers paying him as well? If Trollers is not paying him he is busking with their permission.
By what special privilage are the buisnesses allowed to change the laws established by the port? ....discrimination... enjoyed the vidio, wanna go to the waterfront, not work now.

Trollers is not paying Danny. he is busking.

As Mike Davidson told Piper and I the businesses do not have the authority to allow buskers with their permission.

Remember what happened July 11th when I was given permission at the ice cream shop. I was accosted by three people from the Port Authority and told I had been banned for five years from the waterfront.

This was ten minutes after busker Marty Steele on you tube video had been playing amplified for two hours.

    Truth will always out.

I find the whole situation incomprehensible, and clearley the ice cream shop invitation or rather its consequenses for you were pure discrimination. And in all the time this goes on you are not able to even get a reason or any kind of answer from the port authority. How do they manage to stay so unaccountable?

    Power and Money.
Read the letter to the editor in the DAily News today.

The Port Authority is bound by law to abide by the Charter of Rights and Freedoms.

Unfortunately those who dont have money cannot afford a lawyer to challenge them.

Even if you do have a bit of money it dosnt mean you can find a lawyer willing to take on such a huge challenge. History is full of injustice and it seems it always will be. Says a whole lot about the lack of progress in society and the lack of moral decisions on the part of the "haves", of course not all of them, but power corrupts as they say.

According to Randy Churchill with bylaw services the next meeting regarding busking in Nanaimo will be after the new CEO of the port athority is in place. (Stakeholder) Lets hope this person knows the charter of rights and freedoms and discrimination against licensed buskers will not be a priority for the port athority in 2009.

The Canadian Charter of Rights and Freedoms is something that both you and Queen should examine more. Since you both have disabilities, there could be some provisions in there that could help you both in being able to play on the waterfront without further interruption. But again, you would probably need an attorney to help you decipher those charter rights. I would suggest looking for a pro-bono attorney.

TH much of the reason I have had a problem with the Port Authority is because I carry a small copy of The Charter Rights and Freedoms with me almost all the time.

Usually when I quote my rights is when they send the big guns.

The only busker I have ever seen in Nnanaimo who gets harassed by up to six Port Authority people at one time is me.

Usually it happens when I am alone which is quite intimidating. As a blind person with Post traumatic stress disorder they should be encouraging me to earn a living not trying to prosecute me as a "PUBLIC NUISANCE"

One day the right person will read this forum and the truth will be found out.

    I"M patient.

Thanks TH, you are on the right track but conversations I have had with members of the port authority indicate that they believe they are doing nothing wrong. If you took one of their staff to a spot and pointed out a violation of the law they would stand beside you and call you a liar, That's the type of people we have managing the port property. They think they are above the law as they work for the federal government.
However TH the older I get the less patience I have for them. I believe that I may loose it one day soon and force them into arresting me but I will be well prepared. This is the year we have to bring it all together and stand our ground and enjoy what is available for us to help in raising our families as buskers. The port authority property was not just developed for the rich. In the 1980's I played my accordion on Cameron Island before any condominiums were put up and the Greyhound bus would come in while the bingo players enjoyed a bingo game or 2 upstairs. My question would be where do we get property managers like this and do they sleep at night?

Well, to be honest with you, none of what you wrote really matters to anyone at the port or in the courts. You can get angry about it. You can get arrested for breaking they injunction. But the best way to handle it would be to somehow get an attorney and challenge the issue in a court. Again, a pro-bono legal defence may be the way to go. It's free:

    http://www.probono.ca/

Have a look through the website.

As I said, you and Queen have some disabilities and you cannot do normal jobs, especially with Queen because she can barely see. I think that perhaps the law has treated you unfairly. But no one will recognize that unless a judge hands down a decision saying so.

So, I would encourage both you and Queen to check out the nearest pro-bono office and just go in to talk with someone. Getting arrested on the waterfront for breaking the injunction will probably not accomplish anything productive at all. And you could end up in Brannen Lake Correctional Centre for 6 months. So I would encourage you not to get in any trouble or lose your cool over this.
