    Default McKinnon / Cable Bay violate new rules

    According to the new legislation McKinnon / Cable Bay violated the rules when they privately funded ads supporting Korpan in the November election and failed to properly register with the Chief Elections Officer as a Campaign Organizer.

    Local Firefighters Union 905 also violated the rules by not registering prior to the election and openly endorsing Mayoral candidate Diane Brennan.

    It is speculated (and not denied by McKinnon) that he similarly supported other candidates. Rumors are it was Unger and McNabb who also derived an indirect benefit from McKinnon / Cable Bay.

    I found that the definition for 'campaign organizers" a bit confusing and not sure if it would apply to either the Nanaimo Professional Firefighters Local 905 union or to Roger McKinnon. The Firefighter also promoted candidates for council including some that were elected.


    "campaign organizer" means

    (a) an organization, whether incorporated or unincorporated, other than an elector organization, that undertakes, or intends to undertake, an election campaign that
    (i) augments or operates in place of, or
    (ii) is intended to augment or operate in place of the election campaign of one or more candidates or of one or more elector organizations, or both, or

    (b) an individual who
    (i) undertakes, or intends to undertake, an election campaign referred to in paragraph (a), other than an election campaign for the individual as a candidate, and

    (ii) accepts, or intends to accept, campaign contributions in relation to the campaign from any other individual or any organization, whether incorporated or unincorporated;

    Did anyone EVER consider the voting habits of Korpan,Unger & McNabb to be impartial? if so you must wear blinders.
    Even, on a simplistic note, the campaign handouts were alike & possibly came from the same printers.

    I think so....
    The word AND is very important otherwise it would be OR

    (b) an individual who
    (i) undertakes, or intends to undertake, an election campaign referred to in paragraph (a), other than an election campaign for the individual as a candidate, AND
    (ii) accepts, or intends to accept, campaign contributions in relation to the campaign from any other individual or any organization, whether incorporated or unincorporated;

    Well it works with the "and" too.

    Roger McKinnon augmented Korpan's (and possibly others) campaign(s) AND he took money from Cable Bay to do it.

    I can see your point there... However I would also argue then that MacKinnon was representing an organization (unincorporated or incorporated) as the ads were done as "Citizens of Nanaimo". Sounds like some sort of residents group to me.
