It appears that s. 5.1 of the above-mentioned Bylaw granted that authority to the City Manager -

    5. Appointment and Promotion

5.1 The City Manager has the authority and responsibility as the Senior Manager of the City for hiring, termination and restructure decisions pertaining to all Staff and all departments (subject to compliance with Community Charter requirements).

    Thanks guys.

Well I wonder who is in charge now?
Does Al inherit a similar contract?

    Council.
    No. Not from this council.

[That same contract [bylaw7000] gave Berry complete control over who he chose to hire (Holmes & Howat) and fire (Bowden).

Mr. Bowden was a senior manager and officer of the corporation, yet Berry demoted and eventually forced him out without any vote from council.[/QUOTE]

As he seems to have done with Linda Murray! much to the surprise of Council.

Does anyone know where she went?

I found her to be amazingly well informed and forthright.
I think we lost a valuable resourse there! Too bad!

Jim Bowden landed on his feet as he started with the City of Langford on September 2006 in the newly created position of Deputy Administrator. He is currently A/Clerk Administrator and has overall responsibility for all administrative and operational aspects of the municipality. He is responsible for the statutory functions of Municipal Clerk. His position would be similar to City Manager. The City of Langford which includes Bear Mountain is probably one of the fastest growing communities in BC.

Jerry Berry was given the power to remove anyone from the staff of the city without influence from council. This was done to remove any interference from a council member when hiring or firing of any employee. Council as a whole still maintained the option of voting as a whole to remove any management for particular breaches of laws or city statutes.

She's probably gone on to bigger, better, and much more pleasant and profitable things, as did a friend of mine several years ago.

So that makes Berry's bullying and Korpan's lack of backbone okay then, cause it all worked out for Bowden.

As the Management Terms and Conditions of Employment Bylaw 2005 No. 7000 applies to Managers, which would include Al Kenning, there is the possibility that a Council has entered into a contract of employment with Mr. Kenning, or any other Manager for that matter! (As per s. 16 of the Bylaw referred to in my post #176).

While it is possible, it is my understanding that Berry was the only one that had his/her own exclusive contract. Everyone else (at this time) falls under Bylaw 7000.

Of course this does not preclude future Council from negotiating another exclusive arrangement.
